An employer can take a commission against the tip of the employee to bring their income up to at least the federal minimum wage.  At the time of publication, federal law allows a  credit  of up to US $ 5.12, which when added to direct wages for time equals US $ 2.13 federal minimum wage of $ 7.25 an hour. Depending on the local state minimum wage laws, restaurant servers can be paid what is known as a "minimum cash wage." Certain employees must be paid overtime, at time and one-half of the regular rate, after 40 hours of work in a workweek. However, California does not allow employers to take tip credits. Employers must pay employees at least the California minimum wage for each hour worked, in addition to any tips they may receive.
